Federal Court appoints an additional Assessor the Honourable Lynn Smith

On October 26, 2018, at the request of the parties the Federal Court appointed the Honourable Lynn Smith, a former judge of the British Columbia Supreme Court as an additional Assessor to provide for the timely assessment of claims under the Merlo Davidson Settlement Agreement. The claim period is closed

The extended claim period closed on May 22, 2018.  Under the terms of the Settlement Agreement, the Office of the Independent Assessor may not accept claims that are received after this date.

We are currently reviewing claims that were received before the deadline. We appreciate your patience given the large volume of claims received.  If you submitted your claim in hard copy we will send you a notice of receipt, which will assign a file number, within 2 weeks.

Claim deadline is May 22, 2018

All paper claims must be received by the Office of the Independent Assessor on or before May 22, 2018. A postmark is insufficient.

Please note that our offices are closed May 21, 2018.

Online claims may be submitted until midnight Pacific time on May 22, 2018.

Claimants must ensure that they have provided:

  • a completed claim form;
  • a completed Certification of No Prior Compensation form;
  • a completed Authorization and Direction to Release information form;

Court extends claim deadline for those who signal an intention to file a claim on or before February 8, 2018

On February 7, 2018, the Federal Court issued an order effectively granting a 100-day extension to all primary class members who signal an intention to make a claim for compensation on or before February 8, 2018.  All claims benefitting from this extension must be received by May 22, 2018.

****This order does not have any effect on the decisions already rendered by the Assessor which are final and not subject to appeal or judicial review.******

Important notice to all Merlo Davidson Primary Class Members

 

On January 30, 2018, class counsel filed a motion in Federal Court requesting a hearing as soon as possible, and in any event, before the claim deadline (February 8, 2018).

The Merlo Davidson Settlement Agreement stipulates that claims will not be accepted after the claims deadline which is February 8, 2018. A claim which is postmarked before the deadline but not received will not be accepted.

Claimants who are waiting for supporting documentation may still forward their completed claim forms to the Office of the Independent Assessor to ensure that the claim is received on or before February 8, 2018.

Confidentiality and protection of claimants is paramount

I have heard that many current regular and civilian members of the RCMP, and current Public Service employees, are concerned that if they submit a claim to me, under the Merlo Davidson Settlement Agreement Assessment process, I will launch an investigation into the incidents described in the claim.  They are concerned that such an investigation will result in a breach of confidentiality and that they will be identified as claimants.

Implementation Date for the Settlement Agreement

It is now official: the implementation date for the Merlo Davidson Settlement Agreement is August 1, 2017.

The Independent Assessor will publish the Notice of Settlement Approval on August 12, 2017.

The publication of this Notice begins the180-day claim period during which primary class members may make a claim. The claim period will end on February 8, 2018.

The Notice will also be mailed to individual class members whose addresses are known to the Independent Assessor.
