Court extends claim deadline for those who signal an intention to file a claim on or before February 8, 2018

On February 7, 2018, the Federal Court issued an order effectively granting a 100-day extension to all primary class members who signal an intention to make a claim for compensation on or before February 8, 2018.  All claims benefitting from this extension must be received by May 22, 2018.

****This order does not have any effect on the decisions already rendered by the Assessor which are final and not subject to appeal or judicial review.******

To signal your intention to make a claim on or before February 8, 2018, you MUST do one of two things:

  • Create an online account via the secure web portal on the Independent Assessor’s website on or before February 8, 2018. Please do not write to or email the Assessor’s Office;

OR

  • Write to Class Counsel informing them of your intention to file a claim. Your email or letter must be delivered to Class counsel on or before February 8, 2018:

If you do not signal your intention in one of these ways the deadline to submit your claim will remain February 8, 2018.

Any person who seeks to file a claim without having signalled an intention to proceed on or before February 8, 2018 will have to seek an extension in the manner currently set out in the Settlement Agreement. That is, by completing an extension form and submitting a completed claim form and all supporting documents.

If you have already opened an online account OR if you have retained class counsel you do not need to take any additional steps.
